Residential House Lease Contract

THE LESSOR:
THE LESSEE:

This Lease has been mutual agreed and set up by THE LESSOR and THE LESSEE complying with Economic Contract Law Of The People's Republic Of China.
The lease contract should have the following provisions: 
 
I. Premises Description
The premises to be leased are described as: the housing's location, size, its decoration and facilities and how many rooms it has.
 
II. Lease Term
The term of this Lease shall start on the date____/____/_____ [Move-in Date], and end on _____/______/_____ [Lease End Date] for continuous_________years and_________  months. THE LESSOR should deliver the premises to THE LESSEE on the [Move-in Date], THE LESSOR has the right to use it from the [Move-in Date] until the [Lease End Date].
 
THE LESSOR can terminate the contract and require the LESSEE to return the premises unconditionally in any of the following circumstances:
 
1. THE LESSEE sublet, sell, lend the said premises without the written permission from THE LESSOR.
 
2. THE LESSEE or other resident commits illegal acts or infringe upon the public interests at the rental house.  
 
3. THE LESSEE is six continuous months
 
At its expiration, if THE LESSEE doesn't find a proper house, THE LESSOR should extend the lease term according to the circumstances.
 
If the occupant exceed the time limit and does not move out, THE LESSOR can sue to people court lawfully and apply for execution.
 
THE LESSEE shall bear all the responsibilities caused by such breach, including pay all the court costs and attorney's fees.
At its expiration, THE LESSEE retains his priority to renew this lease if THE LESSOR continues to lease the house.
 
Ⅲ. Charging Standard and Time Limit
 
Rental should be paid according to the prices set uniformly by the state. If no government-set prices, THE LESSOR can determine the charging standard and the time limit after consulting with THE LESSEE. During the lease term, THE LESSOR shouldn't raise the rental arbitrarily.
 
Ⅳ. Housing Repairs
 
THE LESSOR is responsible for repair. In order to provide THE LESSEE a safe place to live in and make sure that all facilities work well.
 
During the repair period, THE LESSEE should lend active cooperation to THE LESSOR and should not prevent the construction. If the house needs fixing up and THE LESSEE cannot afford it, THE LESSEE can help repairing the house after consulting with THE LESSOR. THE LESSOR mortgages his rental to pay the cost or repay the bills in stage.

V. The Change of THE LESSOR and THE LESSEE
 
1. In case that the property ownership is transferred during the lease, THE LESSEE has the right to continue to use the said premises and the contract remain in force to the new property owner.
 
2. If THE LESSOR sells the house,with a must of 90 days prior notice to THE LESSEE, THE LESSEE should has the first refusal under the same conditions with other buyers.
 
3. If THE LESSEE needs to exchange his rental housing with the third man,THE LESSEE should first get the permission from THE LESSOR and THE LESSOR should support the reasonable requests of THE LESSEE.
 
Ⅵ. Responsibility of Default 
 
1. If THE LESSOR doesn't deliver the premise meeting the requirements to THE LESSEE according to the above contract clauses, THE LESSOR should pay a default fine of about_________ yuan.
 
2. If THE LESSOR doesn't deliver the premise to THE LESSEE in time, THE LESSOR should pay a default fine of about_________ yuan.
 
3. If THE LESSOR doesn't repair the premise in time or according to the agreement, he should pay a default fine of about_________ yuan.If any physically injured or property damaged caused by it, THE LESSOR Should be responsible for compensation to THE LESSEE.  
 
4. If the rent has not been paid after it is due and payable, THE LESSEE shall be liable topay a late payment charge of about_______ yuan besides paying the delinquent amount.
 
5. If THE LESSEE break the contract and sublet the premises to others, he shall be liable to pay a default fine of about_________ yuan.
 
THE LESSEE should be responsible for compensation if any damage caused by illegally subletting the premises.
 
Ⅶ. Exemption Clause
 
If losses and damage caused by forces beyond human control, both parties shall mutually bear no liability for the loss.
 
Ⅷ. Dispute Resolution

All disputes arising from the execution of this agreement shall be settled through friendly consultations. In case no settlement can be reached, the case in dispute shall then be submitted to the
Economic Contract Arbitration Commission of the local Industrial and Commercial Administration Bureau for mediation or arbitration. If arbitral adjudication disaffected, it still can sue to people court lawfully.
 
Ⅸ Other Terms
 
Ⅹ Any other matters not expressly statedherein should be accordance with the relevant provisions of the Economic Contract Law of The People's Republic of China without exception.
 
This contract may be revised upon agreement of both parties. Any amendment to this contract shall have the same effect with this contract.
 
This Lease shall come into force upon the signature of THE LESSEE and THE LEESOR. There are two originals of the Contract, one for each person.
