Work Permit for Foreign Experts in Hunan

Permission Item: Work Permit for Foreign Experts in Hunan

 
Permission Target: Employed foreign experts working in Hunan
 
Permission Basis: The Decision of the State Council on Establishing Administrative Licensing for the Administrative Examination and Approval Items Actually Necessary to Be Preserved (No. 412 [2004] of the State Council)
 
Time limit: within 20 working days
 
Qualifications:
The foreign experts applying for "Work Permit for Foreign Experts in Hunan" shall abide by the Chinese laws and regulations, be in good health, have no criminal record, and meet one of the following requirements:
 
1. Foreign technical and managerial personnel employed in Hunan for the implementation of agreements or accords between the Chinese and foreign governments or international organizations and Sino-foreign economic contracts.
 
2. Foreigners employed in Hunan engaging in such fields as education, scientific research, the press and publication, culture and art, health and physical training, etc.
 
3. Foreigners taking the post of deputy general manager or above in Hunan-based enterprises, or foreign senior technical and managerial personnel enjoying the same treatment.
 
4. Overseas expert organizations approved by the State Administration of Foreign Experts Affairs, the People' Republic of China or foreign representatives of the permanent offices of talent intermediary agencies in Hunan.
 
5. Foreign technical and managerial personnel with special expertise or in short supply employed in Hunan engaging in the fields of economy, technology, engineering, trade, finance, accounting, taxation and tourism. The foreign experts referred to in the second or third requirement 
 
The documents required for application:   
 
1. Foreign Experts Work Permit Application Form;
 
2. Resume (including educational background, working experience);
 
3. Copies of the highest academic degree or professional qualifications;
 
4. The health certificate provided by foreign health and medical institutions approved by Chinese embassies and consulates abroad or health and quarantine departments designated by Chinese government;
 
5. Employment agreement or contract:
 
The foreign experts referred to in the first requirement shall submit copies of relevant project agreements and approved documents;
 
The foreign experts referred to in the second requirement shall submit copies of qualification approval certificate by the employer or certificate number and standard employment contract signed with the employer and printed exclusively by the State Administration of Foreign Experts Affairs;
 
The foreign experts referred to in the third requirement shall submit corporation appointment or copy of employment contract;
The foreign experts referred to in the fourth requirement shall submit copy of approval document of permanent representative offices in China and copy of appointment of foreign representative offices or other legally valid dispatch document;
 
The foreign experts referred to in the fifth requirement shall submit copy of employment agreement or contract.

Procedures:
 
I. Acceptance
 
1. The person in charge: officials in the Office of Foreign Experts Affairs (Tel: 0731-82215730, Website: www.hnrst.gov.cn)
 
2. The responsibilities and authorities:
 
Checking whether the application materials are complete or not and whether they meet the statutory form or not, whether the application items are within the authority of administrative subject or not, whether the application is made within the time limit prescribed by the law and regulation or not and whether the applicant is qualified or not; deciding whether to accept the case or not; deciding whether to accept the case or not according to the legal requirements and standards of licensing and making determinations in accordance with Article 32 of the Administrative Permission Law:
 
(1) Immediately informing the applicant of the denial if the application items do not need administrative permission in accordance with the law;
 
(2) Making the decision of denial and informing the applicant of applying to the administrative organ concerned if the application items are beyond the authority of the organ ever applied for;
 
(3) Permitting on-the-spot correction by the applicant if there are any mistakes on the application materials;
 
(4) Informing the applicant on the spot or within 5 work days of all contents that need correction if the application materials are not complete or they do not meet the statutory form; Those not informed of within the time limit can be seen as acceptance since the receipt of application materials;
 
(5) Accepting the application of administrative permission if the application items are within the authority of the administrative organ and the application materials are complete and meet the statutory form or the applicant submits the application materials in line with the requirements;
 
(6) Issuing a written document with designated stamp and date indicated, be it acceptance or rejection of the application.
 
3. Time limit: immediately
 
II. Censoring
 
1. The person in charge: officials in Office of Foreign Experts Affairs
 
2. The responsibilities and authorities:
 
(1) Examining the legality and authenticity of the materials submitted by the applicant according to permissive conditions and standards, informing the applicant of all contents that need correction within the 5 work days if any;
 
(2) Submitting preliminary examination opinion to persons in charge of the relevant sections for approval.
 
3. Time limit: within 5 work days
 
III. Decision
 
1. The person in charge: persons in charge of the Office of Foreign Experts Affairs
 
2. The responsibilities and authorities:
 
(1) Approving application materials and verifying opinions in accordance with the permissive terms and standards;
 
(2) Writing remarks of approval on the Work Permit for Foreign Experts in China for those conforming to the legal terms and standards and proceeding with the formalities;
 
(3) Writing opinions of denial to those not conforming to the legal terms and standards, returning the approval form to undertaker and explaining the reason in written form.
 
3. Time limit: within 7 work days
 
IV. Notification and publication
 
1. The person in charge: officials in the Office of Foreign Experts Affairs
 
2. The responsibilities and authorities:
 
(1) Promptly and accurately informing the applicant of taking the permit;
 
(2) Informing the applicant whose application is not approved of reasons, related rights, complaint channels, and returning the application materials;
 
(3) Filing away the textual materials as required.
